Or is there another cell tower located across the street or adjacent to your property and Tillman made you an offer? Are you wondering what are the average cell tower lease rates for Tillman cell phone towers?

Searching for a cell tower lease consultant who can help you or your attorney with the Tillman cell tower lease negotiation? Tower Genius knows Tillman Infrastructure’s Business Model

About Tower Genius. This is a photo of the two Partners from Tower Genius LLC, Kevin Donohue, and Steve Kazella, with the Tower Genius logo, and a cell tower. They have been helping land owners with Tillman Infrastructure cell tower lease proposals since 2016.
Tower Genius has been dealing with Tillman cell tower leases since 2016.

Funny thing, but Tillman actually tried unsuccessfully to recruit one of the managing partners of Tower Genius to run their operation in New York City when they launched back in 2016. Tillman has positioned itself as a wireless industry disruptor, offering wireless carriers like Verizon, T-Mobile and AT&T a cheaper alternative than American Tower, Crown and SBA. They do build to suit cell tower development but they also look for existing cellular towers in rural areas with little or no zoning restrictions and develop towers in close proximity to existing towers, and “show a lot of leg” to entice the wireless tenants to jump ship onto their cheaper towers.

The Tillman Infrastructure lease agreement generally offers rigid business terms to landowners with little to no flexibility, low rents and very long leases that will outlive you and possibly your kids.

When you’re approached by Tillman Infrastructure LLC for having a new cell tower built on your property, you face a crucial decision. Tillman prides itself on being a “wireless industry disruptor,” but as you may already know, their lease agreements are not very landlord friendly at all, and their terms can be considered excessive to say the least.  Property owners who attempt to negotiate with Tillman frequently find themselves at a disadvantage, and Tillman may walk away if they sense resistance or find alternative sites. In fact, they are probably talking with 4 or 5 of your neighbors to see who is willing to give them the cheapest deal.

When Tillman Infrastructure LLC Gives You Lemons, You Can Either Make Lemonade or Walk Away

Having your body dragged over broken glass is one way to describe the Tillman cellular tower lease negotiation process. Negotiating a cell tower lease agreement with Tillman Infrastructure LLC usually consists of Tillman’s representative contacting you, you are going out and spending money to hire an attorney, sending the marked-up lease back to them, and then Tillman responding, “this is the lease, take it or leave it.”

Typically, Tower Genius recommends two to three dozen modifications on any lease agreement we look at that a property owner and your attorney would consider. With Tillman, there are more changes suggested due to the content of the document. With that being said, we have found that Tillman will usually not agree to 85% of the changes we would suggest to any client. So how Tower Genius we add value?

Simple, our job is to educate landowners and their attorneys about the Tillman Infrastructure lease, and make you aware of certain terms and what the potential implications are. You can then make informed business decisions and decide if you can live with their cell tower on your property, or not. Some property owners can, and some can not.

Unlike typical cell site leases, Tillman’s cell tower leases are a special category. Let’s just call them “special”. Tower Genius is a telecommunications consulting firm that specializes in helping property owners through the cell tower leasing and negotiating process. We are not a law firm, and we are not attorneys. But we do get hired by attorneys regularly to assist their clients with Tillman cell tower offers. It’s important to know where you have leverage and room to negotiate, and what provisions of the lease are non-negotiable. Unfortunately, many well-intentioned attorneys that are unfamiliar with cell tower leases end up hurting their clients by trying to negotiate with Tillman, where it is almost certain that they are unwilling to budge.

What Are the Do’s and Don’ts of Handling New Cell Tower Proposals from Tillman Infrastructure?

When approached with a new Tillman cell tower proposal, ask as many questions as you can. Ask them if this is a brand new tower, ask them who the carrier is they are building it for, and ask them about what will happen with the nearby tower? In most instances there is another cell tower nearby that they are trying to compete with.

The Do’s of talking to Tillman Infrastructure:

– Try to get back to them within 24 hours of being contacted.

– Express some interest but not too much interest.

– Let them know that you can get a deal done fast.

– See if they can get a crew out to survey your land.

– Give them permission to set foot on your property (Entry & Testing agreement).

– Offer them with a copy of a property survey if you have one.

– Get their business card and don’t lose it. Take a picture of it.

– Give them your phone number and email address.

– Have them send you a draft copy of their lease to read.

– Ask them how much rent they will pay you. Don’t make a counter offer. Tell them you will think about it.

The Don’ts of Talking to Tillman Infrastructure:

– Don’t appear eager and don’t start negotiating anything.

– Don’t sign any Letters of Intent or Term Sheets.

Your answer for everything is, “let me think about it and get back to you.”
