An option lease gives the cell tower developer the option to tie up your property and conduct their due diligence on your site, making sure they can get their permits and build the cell site. Option lease agreements turn into lease agreements when they exercise their Option, or send you a Commencement Letter. Landlords are typically offered a $500 option payment per year. Is that what you should agree to? Probably not. A ground lease (land lease) or rooftop lease does not have an option period.
How long does it take to negotiate a cell tower lease agreement?
The cell tower lease negotiation process can take a few minutes if you sign the “take it or leave it” lease template they hand you. Or it can take 3 to 6 months in most cases, or even a year or longer, depending on the complexities of the property and the terms that need to be negotiated. Think of it as a steak. You can get a McDouble in 3 minutes at the McDonald’s drive-thru, or you can dry age a steak for a month before it is ready to be thrown on the grill.
